The Clarion Call: Tenth Amendment Rally | Saturday

A clarion call is a powerful request for action or an irresistible mandate. It derives from the sound of a clarion, a medieval trumpet… Used in a political context, it issues a challenge for action from the public.

Voter frustration and anger remains at an all-time high. Congress continues to turn a deaf ear to constituents, passing sweeping legislation it hasn’t read: bank bail-outs, stimulus packages, mandatory health insurance, car company bail-outs. Administrations rely more and more on executive orders to circumvent the system of checks and balances. The net result is an unprecedented, over-reaching federal power grab far beyond the limits set by the United States Constitution.

But there is a remedy. And courageous states around the country are invoking it. It’s the Tenth Amendment to the United States Constitution: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

On Saturday, August 21 at 1:00 P.M., Rhode Islanders are invited to the front plaza (Smith Street side) of the State House in Providence to celebrate The Clarion Call – The Tenth Amendment Rally.

Around the country, there has been growing interest in – and much misinformation about – the Tenth Amendment, states’ rights, and nullification. The purpose of the rally is to put the Tenth Amendment into accurate historical and contemporary context, and will feature speakers from community, business, and government watch-dog groups. Presentations will include description of federal policies and mandates that exceed constitutional authority, and how states are under no obligation to abide by unconstitutional federal legislation.

Christopher Carlozzi, member support manager and activism coordinator from the Boston office of the National Federation of Independent Business (NFIB), will speak about the lawsuit filed by 20 states – and joined by NFIB – to challenge the constitutionality of the federal health care bill. Mr. Carlozzi will highlight some of new health care mandates and the effects they will have on small businesses.

Using events in other states as examples, other speakers will describe how legislatures around the country are successfully exercising their rights under the 10th Amendment to challenge or nullify over-reaching federal mandates. Locally, asserting Rhode Island’s sovereignty under the 10th Amendment can be key in improving Rhode Island’s economic health and restoring more local, constitutional control. Speakers will note examples of federal encroachment on Rhode Island’s rights and how it directly impacts the state’s financial condition in areas of business, education, the commercial fishing industry, and illegal immigration.

Adam “Maverick” Muccino, producer of the Matt Allen Show on radio station 630 WPRO-AM, will be the master of ceremonies for the event.

Public Rally to Celebrate States’ Rights | Saturday

On March 27, 2010, a group of concerned citizens will be holding a rally from 1:00 – 4:00 p.m. at the Rhode Island State House to celebrate the 9th and 10th Amendments to the U. S. Constitution. The Rally is open to the public and will be held on the front steps of the State House.

Speakers who have been invited to speak are Governor Donald L. Carcieri, Representative Joseph A. Trillo (R-Dist. 24 Warwick), and Representative John J. Loughlin (R-Dist. 71 Little Compton, Portsmouth, Tiverton). A complete listing of speakers will be posted early next week on the web site: http://www.rhodeislandtenthamendmentcenter.com.

The rally will be hosted by Helen Glover of Talk Radio 920 WHJJ.

The 9th Amendment, entitled “Construction of Constitution,” reads “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”

The 10th Amendment, entitled “Powers of the States and People,” reads “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Representative Joseph A. Trillo submitted a House resolution (H-7030) in January calling on President Obama and the Congress to refrain from enacting any law or imposing on the states any regulation that would encroach on any powers reserved to the people or the States in the 9th and 10th Amendments.

Attorney General Candidate Erik Wallin Calls on Attorney General Lynch to Protect the Constitutional Rights of Rhode Islanders

March 23, 2010 – Erik Wallin, Candidate for Rhode Island Attorney General, today called upon Attorney General Lynch to undertake an immediate review of the $938 billion dollar health care bill signed into law by President Obama. Wallin said “Provisions of this bill are unconstitutional as they infringe upon not only our individual liberties but states’ rights as well. Attorney General Lynch should therefore immediately review this bill and institute a legal challenge in order to defend our state from further infringement by the federal government.”

Wallin continued, “Never has the federal government attempted to force individual citizens to buy a good or service simply on the basis that they are Americans. Indeed, the fact that we are Americans, gives us the very right to challenge such an action, and that, as a state, we must. There are serious constitutional protections at stake, specifically the 10th Amendment. The 10th Amendment states: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” Wallin added, “Nowh ere in the U.S. Constitution does it state that the federal government can require an American to buy a commodity, therefore, such ability is reserved to the states – and that doesn’t exist here in Rhode Island.”

Pointing out that Rhode Island faces a possible $400 million dollar deficit in fiscal year 2011, Wallin stated, “This healthcare bill will shift hundreds of millions of dollars in unfunded mandates onto the already breaking backs of Rhode Island taxpayers.” He noted that recent estimates by the state Department of Human Services suggesting that the overall cost to Rhode Island taxpayers would be upwards of $1.5 billion over 10 years. Wallin continued, “While state budget issues, jobs, and tax increase are also of great concern, from the perspective of the Attorney General, protecting our state’s constitutional rights must be paramount.”

Wallin urged Attorney General Lynch to confer with othe r Attorneys General from around the country who are presently preparing suits to challenge the health care bill, including state attorneys general from Florida, South Carolina, Nebraska, Texas, Michigan, Utah, Pennsylvania, Alabama, South Dakota, Louisiana, Idaho, Washington, Virginia and Colorado.
